Rules of Play

These rules govern the Branch 370 50/50 raffle. They must be approved by the licensing authority before any ticket is sold, and they may not be amended without at least two weeks’ advance approval from the Registrar.

1. Definitions

"The branch"
The licensee named in the licence, being the Royal Canadian Legion branch at 24 Dundas St, Iroquois, Ontario. The exact incorporated legal name is TBC — to be confirmed on the licence.
"The raffle"
The Branch 370 50/50 electronic raffle conducted under the licence, in which one winner receives half the value of tickets sold.
"Draw"
A single sales period ending in one random selection of one winning ticket.
"Ticket"
A numbered entry issued by the electronic raffle system and recorded against a purchaser. A ticket is an entry, not a certificate of ownership, and has no value in itself.
"Bundle"
A quantity of tickets offered at a single price, as published in clause 6.
"Electronic raffle system" (ERS)
The certified system, supplied by a supplier registered with the AGCO, that issues tickets, records sales and selects the winning number.
"The Registrar"
The Registrar of Alcohol and Gaming, appointed under Ontario law, who licenses electronic raffles.
"AGCO"
The Alcohol and Gaming Commission of Ontario.
"Cut-off"
The published date and time after which no ticket enters that draw.
"Poppy Trust Fund"
The trust fund held at branch level under the Legion Poppy Manual, used only to support Veterans and their families. It is not part of this raffle in any respect.

2. Licensee and licence

  1. The raffle is conducted and managed by TBC — licensee legal name to be confirmed ("the branch"), of 24 Dundas St, Iroquois, Ontario K0E 1K0, telephone 613-652-4516.
  2. The raffle is conducted under lottery licence number #RAF####### [TBC — client to confirm]. No ticket may be sold, and no advertising may display a licence number, until the licence is issued by the Registrar.
  3. Electronic raffles are licensed by the AGCO Registrar regardless of prize value. A municipal licence does not authorise an electronic raffle, and the branch does not hold itself out as licensed until the Registrar has issued a number.
  4. The licence number appears on every ticket and in all advertising, including on this website, once issued. If you see a Branch 370 raffle advertised without a licence number, it is not ours.
  5. The branch remains responsible for the conduct and management of the raffle at all times. Engaging a registered supplier does not transfer that responsibility.

3. Eligibility

  1. Purchasers must be 18 years of age or older. Where any prize includes alcohol the minimum age is 19; this raffle awards cash only.
  2. Both the purchaser and the vendor must be physically located in Ontario at the time of sale. Residency is not the test; physical presence is. A person who lives in Ontario but is outside the province at the moment of purchase is not eligible for that purchase.
  3. The supplier's checkout performs the binding age and location checks. Nothing on this website constitutes a check, and passing the age prompt on this site does not make you eligible.
  4. The following persons may not purchase a ticket: members of the branch executive and any branch staff or volunteers involved in the conduct and management of the raffle; employees of the electronic raffle supplier; employees of the AGCO; and members of the same household as any of the foregoing.
  5. A person who is subject to a self-exclusion arrangement they have entered into should not purchase. The branch cannot enforce third-party self-exclusion lists and does not represent that it can.
  6. The branch may refuse a sale, or void a sale already made, where these conditions are not met. A voided sale is refunded in full.

4. The electronic raffle system

  1. Tickets are issued through an electronic raffle system supplied by a supplier registered with the AGCO. The supplier is TBC — not yet selected.
  2. Winning numbers are selected by a random number generator forming part of that certified system. Neither the branch, nor any officer or volunteer of the branch, nor any individual employee of the supplier, can influence the selection.
  3. The system records every ticket issued, voided and refunded. That record is the authoritative record for the purposes of these rules. Where a purchaser's own record and the system record differ, the system record governs.
  4. The system enforces the cut-off automatically. A transaction that has not completed at the cut-off does not enter that draw.
  5. Records of sales, voids, refunds and the draw itself are retained for the period required by the Registrar and are available for audit.

5. Sales period and the draw

  1. Sales open on TBC and close at 12:00 noon on TBC (proposed: the last Thursday of each month).
  2. The draw takes place at the branch hall, 24 Dundas St, Iroquois, Ontario, on TBC (proposed: the Saturday following the close of sales).
  3. The draw is open to the public and will be photographed or livestreamed. Attendance is not required to win.
  4. The draw is conducted in the presence of at least two people authorised by the branch executive, at least one of whom is not involved in day-to-day raffle administration.
  5. Immediately after the draw the branch records the winning number, the total value of tickets sold and the resulting prize, and publishes them on the Winners page.
  6. No ticket sold after the published cut-off is entered into that draw, whatever the reason for the delay.

6. Tickets and prices

  1. Prices are in Canadian dollars and include all applicable amounts. There is no additional service or processing fee charged by the branch.
  2. There is no limit on the number of bundles one person may buy. Buying more tickets increases the number of entries held, and therefore the chance of holding the winning entry; it does not increase the value of the prize beyond the effect of the additional sale itself.
  3. Tickets are personal to the purchaser. They may not be sold on, transferred, assigned or given as security. A ticket presented by anyone other than the recorded purchaser will not be paid without evidence satisfactory to the branch.
  4. Tickets are void if issued in error, if the purchaser is ineligible, if payment fails or is reversed, or if the sale breaches these rules.

7. Payment and ticket confirmation

  1. Payment is taken by the electronic raffle supplier on its own checkout. The branch never sees or stores your card details. This website takes no payment of any kind.
  2. Card processing is handled under the supplier's PCI DSS obligations. Questions about payment security are answered by the supplier, whose details will be published here once selected.
  3. On completion you receive confirmation by email showing your ticket numbers, the draw they are entered in, and the amount paid. Keep it: it is what you present when claiming.
  4. If payment succeeds but no confirmation arrives, contact the branch on 613-652-4516 before the cut-off. Tickets recorded by the system are entered whether or not the email reached you.
  5. A payment that is reversed, charged back or otherwise not honoured voids the tickets it paid for, including retrospectively. If such a ticket has already been drawn as the winner, the next validly drawn number is treated as the winning number.

8. Prize

  1. The prize is 50% of the total value of tickets sold in the draw. The remaining 50% is retained by the branch.
  2. Because the prize is a share of sales, its value is not known until sales close. Any amount published before the close of sales is an estimate, is labelled as such, and may go up or down.
  3. No minimum or guaranteed jackpot is offered. In a village of about 1,400 people an early jackpot may be modest. If the branch ever offers a guaranteed minimum it will be disclosed as "guaranteed" rather than "estimated", and underwritten before publication.
  4. There is one prize and one winning ticket per draw.
  5. The prize is paid in Canadian dollars by cheque or electronic transfer, at the branch's option, within a reasonable period after the claim is validated.
  6. The odds of any single ticket winning are one divided by the total number of tickets sold in that draw. Because the total is not known until sales close, the odds cannot be stated in advance.

9. Acknowledgement before purchase

  1. Every purchaser must acknowledge acceptance of these Rules of Play before the sale is completed. The acknowledgement is recorded by the electronic raffle system.
  2. The version of these rules in force at the moment of purchase governs that purchase. Earlier versions remain available on request.

10. Refunds and cancellation

  1. Tickets are not refundable once issued, except where a ticket is voided by the branch or the system (for example, failed payment, ineligible purchaser, or duplicate issue), in which case the full purchase price is refunded to the original payment method.
  2. If a draw is cancelled, all ticket purchases for that draw are refunded in full. A cancellation is announced on this website and by direct contact with purchasers.
  3. Refunds are made to the original payment method only. The branch does not pay refunds in cash.
  4. This clause must match the refund policy in the licence application exactly. Where they differ, the approved policy governs.

11. Errors, interruption and events beyond control

  1. Where a technical fault, pricing error or display error results in a ticket being issued on terms not authorised by these rules, that ticket is void and is refunded. An error in a published figure does not create an entitlement to that figure.
  2. If the electronic raffle system becomes unavailable during a sales period, the branch may extend the sales period or cancel the draw, subject to the Registrar's direction. Any extension is published here before the original cut-off wherever practicable.
  3. If the draw cannot be held on the published date because of severe weather, power failure, bereavement or a similar event outside the branch's control, it is held at the earliest practicable date and the new date is published here.
  4. Neither an interruption nor a rescheduling changes the tickets already validly issued.

12. Publicity

  1. By purchasing, the winner consents to publication of their first name, last initial and municipality for the purpose of announcing the result. No other personal information is published.
  2. A winner who does not wish to be named may say so; the branch will publish the winning ticket number and prize amount only. Declining publicity does not affect the prize.
  3. The branch may photograph or film the draw itself. It does not publish images of purchasers without their consent.

13. Claiming a prize

  1. The winner is contacted using the details supplied at purchase, and the result is posted on the Winners page.
  2. To claim, the winner must produce the winning ticket confirmation and government-issued photo identification confirming they are 18 or older and that they are the recorded purchaser.
  3. Prizes must be claimed within six months of the draw date.
  4. Where the recorded purchaser has died before claiming, the prize is paid to their estate on production of the usual documentation.
  5. The branch does not pay a prize to a person other than the recorded purchaser, except under clause 13.4.
  6. The branch will never telephone, email or message you to ask for a payment, a fee or your banking password in order to release a prize. Any such request is fraud and is not from us.

14. Unclaimed prizes

  1. If a prize is unclaimed, the branch will make documented efforts to contact the winner and will advertise the unclaimed prize within 120 days of the draw.
  2. A prize still unclaimed six months after the draw is dealt with as directed by the Registrar. It is not absorbed into branch funds at the branch's discretion.

15. Complaints and disputes

  1. Raise a concern first with the branch, by email to info@legionbranch370.ca, by telephone on 613-652-4516, or through the contact page. Give the draw date, your ticket numbers and what went wrong.
  2. The branch acknowledges a written complaint within five business days and aims to answer it substantively within thirty days.
  3. A complaint about the conduct of a licensed lottery scheme that the branch cannot resolve may be taken to the AGCO. A complaint about the handling of personal information may be taken to the Office of the Privacy Commissioner of Canada — see the Privacy Policy.
  4. Nothing in these rules removes a right you have under Ontario or Canadian law.

16. Privacy

  1. Personal information collected for the raffle is handled as set out in the Privacy Policy, which forms part of these rules.
  2. Information is collected because the AGCO requires the licensee to verify eligibility, issue tickets, pay prizes and maintain an audit trail — not for marketing. Marketing consent, if it is ever sought, is sought separately and can be withdrawn.

17. Tax

  1. A raffle ticket is not a gift and no charitable tax receipt can be issued for it. This is the Canada Revenue Agency's position on lottery tickets generally, not a choice the branch has made.
  2. Branch 370 is not currently a CRA-registered charity. Eligibility to hold a lottery licence is assessed separately by the licensing authority and does not require CRA registration.
  3. Lottery winnings are generally not taxable as income in Canada. The branch does not give tax advice; ask your own adviser about your circumstances.

18. Use of proceeds

  1. The branch's 50% share supports general branch operations, including hall maintenance, veterans' support programs administered by the branch Service Officer, and community events.
  2. Raffle proceeds are separate from, and are never used as, Poppy Fund donations. The Poppy Trust Fund is held in trust, may not be used as or in place of general or any other branch funds, and is governed by the Legion Poppy Manual.
  3. Buying a ticket does not donate to the Poppy Fund. Donating to the Poppy Fund does not enter you in the raffle. The two are kept apart in the branch's accounts, in its tooling and on this website — see Remembrance & the Poppy Fund.

19. Advertising

  1. Advertising for the raffle must be truthful, must not overstate the prize, must not be directed at people under 18, and must not present buying tickets as a solution to financial difficulty. This reflects the AGCO's advertising standards for licensed lotteries.
  2. Every advertisement carries the licence number, the 18+ requirement, the Ontario-presence requirement and the ConnexOntario line.
  3. Estimated prizes are labelled "estimated" in every medium, not only on this website.

20. Amendments, governing law and interpretation

  1. These rules may not be amended without the Registrar's approval, requested at least two weeks in advance of the change taking effect.
  2. Each published version carries a version number and an effective date. The version in force at the time of purchase governs that purchase.
  3. These rules are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it.
  4. If any clause is found to be unenforceable, the remaining clauses continue in force.
  5. Any question of interpretation is decided by the branch executive, subject to the licensing authority's direction.
